20-Sep-2025 (In Divorce Law)
Hi, My sister filled SLP against the divorce decree of Hc on the ground of cruelty. My sister could file SLP post 90 days of divorce decree due to summer vacation in SC . Got to know my brother in law remarried post 90 days and got one kid also last month from his second marriage . Our SLP yet to listed for judgement in SC . What can happen in this case ? My BIL already moved on and has one kid also from his new marriage ? Can still divorce decree be set aside ?

In Divorce Matters (Cruelty Ground) If the High Court has granted divorce on cruelty, the aggrieved party (husband or wife) can file an SLP in the Supreme Court challenging the decree. If the High Court has dismissed divorce, the petitioner can also approach the Supreme Court via SLP.
