Query concerning the false breach of the Roka ceremony

02-Jan-2026 (In Divorce Law)
My Roka ceremony was held on 24th August, finalized with the decision and approval of the pandit from the boy’s family, and conducted at the exact auspicious muhurat. However, a few months later, the alliance was broken on the grounds that their pandit later declared it was not a suitable match. This act not only disrespected my family and me but also caused deep emotional hurt, as I was sincerely attached to the commitment. What will be the valid action against them?

1. Civil Suit for Damages (Compensation) A suit for mental harassment, loss of reputation, and expenses incurred can be filed if: • Engagement was done with clear commitment • Money was spent on arrangements, gifts, venue, etc. • The breakup was arbitrary, dishonest, or in bad faith You can claim: • Compensation for emotional distress • Recovery of expenses • Damage to social reputation This is filed as a civil suit for damages. ⸻ 2. Cheating (IPC 420) – Only in strong cases A criminal case for cheating can be considered only if it can be shown that from the beginning: • They never intended to marry, and • They induced you into Roka to gain something (money, gifts, benefits, etc.) If they broke the alliance later due to change of mind or family reasons, then 420 will not stand. Courts are strict on this. ⸻ 3. Defamation (if public humiliation occurred) If they: • Publicly made false statements • Blamed your character • Insulted you or your family socially Then a criminal complaint under Defamation (IPC 499/500) or a civil defamation suit is possible. ⸻ 4. Recovery of Gifts / Money If there were: • Expensive gifts • Cash transfers • Jewellery • Engagement expenses paid by your side A legal notice + recovery suit can be filed.
