Possible Conflict of Interest & Bailable warrant Issued in 498A Case

It has come to my knowledge that my lawyer, Amit Chaudhary, is associated with the opposition party. Additionally, in my sister’s case under Section 498A, a bailable warrant has been issued. Kindly advise on the appropriate legal steps to be taken in this matter

You need to be more specific about your query. In the reference to your advocate you can change the advocate at any point of time if you are not happy with your counsel. In your sister’s case you have to provide more details as to what is the stage of the complaint.

You should get an NOC from your lawyer, get your case files back, find a new lawyer and have your new lawyer file your Vakalatnama. For the bailable warrant, you should file for cancellation of warrant or get the release on a bail bond.

If you genuinely apprehend that your lawyer’s association with the opposite party may prejudice your case, you are fully entitled to change your counsel, as the client-advocate relationship is based on trust and confidence; if necessary, you may also file a complaint before the appropriate Bar Council with supporting material. Regarding your sister’s case under Section 498A IPC, since a bailable warrant has been issued, she should promptly appear before the concerned court and furnish the required bail bonds to secure release, along with moving an application for recall of the warrant to avoid escalation into a non-bailable warrant and further complications.
