file application under order XL1 rule 14 to have wife serve the notice again to be filed by husband but case will not be dismiss if court believes its need to be move forward on evidence. best option is to file application and then move forward with the case

Yes the case can definitely be dismissed on the sole ground that the principle of natural justice was not followed by not issuing the summons to the other party. It is stated that proper service of summons is of utmost importance as it is the said summons which intimate the other side about the legal proceedings. It is extremely important for both the sides to be aware of the proceedings, as the absence of the same is violative of natural justice. Hence the same can be challenged and we may even get the same dismissed.

Hi, If the wife has filed an MFA appeal in the High Court but the case is showing “non-compliance of office objections” for the last 9 months, it means the appeal has not been properly processed or numbered due to defects pointed out by the registry. Until those objections are removed, the appeal may not be listed before the bench.
