Hello, In this case, you can file a case for mandatory injunction before the concerned Family Court. Through this case, you can seek a direction from the court to your spouse to immediately restore the electricity connection to your residence. Such an act of disconnection amounts to harassment and deprivation of basic amenities, and the court can intervene to ensure that essential facilities like electricity are not used as a means of coercion or pressure.

You can immediately file a petition for a mandatory injunction in the court handling your civil/family dispute. Request the judge to order restoration of the electricity supply, arguing that your wife’s action constitutes harassment and deprivation of basic amenities for dependent family members. Approach the local police station to file a complaint for harassment, especially since your children and aged parents are affected. Attach evidence: electricity bills, your civil case reference, proof of residence, and supporting documents. You can also mention this issue in your pending civil case, highlighting her act as further cruelty and pressure

Immediate Legal Remedies 1. File a Complaint to Electricity Department: Go to your local electricity board office and file a written complaint stating that disconnection was done maliciously by your wife even though old parents and minor children live there. Request restoration of supply in your or your children’s name (as occupants). Attach your Aadhaar, children’s school proof, and pending civil case details. 2. Police Complaint (under harassment): File a written complaint (NC or FIR) at your local police station under sections related to criminal intimidation and harassment. Mention that she is intentionally causing hardship to your dependent parents and children. 3. Application in Pending Civil Case: Through your lawyer, file an interim application under Order 39 Rule 1 & 2 CPC seeking temporary injunction to restrain her from disconnecting utilities or creating obstruction in residence. The court can order restoration of electricity until final judgment. 4. Maintenance of Essential Services: Under the Senior Citizens Act (2007) and Domestic Violence Act (Section 19), you can request that essential utilities not be disrupted for dependents living in the shared household.
