hi, I can well understand your concern from the query raised, if the filing for divorce has been made upon unsubstantiated grounds, then the petition is deemed to be dismissed, kindly be aware of the circumstances and act, you can go for a mutual divorce if parties are ready to settle the matter amicably, thank you

✅ 1. Can you get cheated in the mutual divorce process? Mutual consent divorce under Section 13B of the Hindu Marriage Act is a structured legal process. Since both parties must file a joint petition, appear twice in court, and confirm consent on record, chances of being cheated are low if the terms are clear and recorded properly in the petition. However, since they earlier filed a false case and now approach with a different advocate, you must: Ensure the false allegations are withdrawn or disposed before mutual divorce is filed. Include clear terms in the mutual divorce petition: custody, maintenance (if any), property, etc. File through your trusted lawyer who can safeguard your son’s interests. ✅ 2. What if they earlier demanded money but now say “no money”? This may be a change in stand, possibly due to realizing the weak legal ground in the false case. Even so, record “no monetary claim” explicitly in the mutual divorce petition to avoid future disputes.

Dear Client, 1. Consult an advocate to discuss your case in brief. 2. You may schedule an appointment regarding your case by phone or email at your convenience. Thanks & regards, Priyanka Advocate Coimbatore
