Mutual concent divorce with child Custody

I want to end my marriage but my baby is 4 month old. Can I ask my husband to take child Custody n get out of marriage? What if he doesn't agree to take care of baby? Any ways of mutual agreement possible? What if he accuses me about depression?

if the divorce is mutual and one of the spouce is unwilling to accept custody then the other spouce can easily eat the exclusive custody in case he or she wants. if both the parents wants to get rid of the custody then it's better to explore the option of adoption. thanks & regards, Tanmoy Chattopadhyay, M.Sc (Net Qualified), LL.B (University of Delhi), Advocate, Hon'ble High Court at Calcutta.
