Misconsumption of demand of husband as dowry demand

24-Jul-2025 (In Divorce Law)
When marriage happens, wife has been given rights over husbands property and she has been entitled to live and use husband house, other needs that is not considered as dowry. When husband demands over wifes property it has been treated as dowry demand. Either there must be a demand or must law for equal share of husbands property to wife and wife property to husband then there won't be any demand. Why any court are not commenting on equal assets share of husband over wife assets and wifes asset

Under Indian law, a wife does not automatically get rights over her husband’s property just by marriage. However, she has the right to reside in the matrimonial home under the Protection of Women from Domestic Violence Act, 2005, which is often misunderstood as property entitlement. Dowry demand, as per Section 2 of the Dowry Prohibition Act, 1961, refers to any demand made for property or valuable security from the bride’s side. There is no legal provision for automatic equal asset sharing between spouses unless mutually agreed or directed in divorce proceedings. Courts focus on maintenance and alimony based on the wife's financial needs and husband's capacity. There is no uniform law on marital property division in India. That’s why courts haven’t given rulings on equal sharing of each other's assets during marriage. A uniform marital property law is needed to bring true equality.
