Minor one year old daughter custody advice. Emotional and mental abuse

29-Nov-2025 (In Divorce Law)
I and my husband both are government servants and earn equally. He and his parents have harassed me to take leaves or quit job. I take care of her alone whenever I am at home including full weekends. When I and my husband goes to office, in laws, nanny takes care( my parents also done for 5 months). Can my husband be granted custody? Should I file dv, divorce and custody together

For a minor child below 5 years, Indian courts generally prefer the mother as the natural guardian for physical custody, unless there is strong evidence against her (neglect, abuse, incapacity, etc.). Relevant Acts: Guardians and Wards Act, 1890 Hindu Minority and Guardianship Act (if applicable) Special Marriage Act / Muslim Law Personal Law (if applicable) Best But final decision always depends on: interest, safety, and well-being of the child

Yes, it is legally possible for you to file all three cases at the same time — divorce, DV and child custody. Under Indian law, you have the right to seek relief if you have been subjected to mental cruelty and harassment, including being forced or pressurised to leave your government job by your husband or in-laws. Such conduct is recognised as mental and emotional abuse and can be valid grounds for legal action. You can file a divorce petition on the ground of cruelty. You may also file a Domestic Violence complaint before the Magistrate Court to seek protection, residence rights, monetary relief, and interim custody of your minor child. Additionally, a child custody petition can be filed. Courts generally prioritise the welfare of the minor child and tend to favour the mother’s custody, especially when the child is young and the mother has been the primary caregiver. It is advisable to file the Domestic Violence case first for immediate protection and temporary custody, followed by the divorce and custody cases. You should preserve all evidence such as messages, records of harassment, and proof of your employment to strengthen your case.
