Matrimony issue acid attack divorce alimony

Wife file false 498a on me & my relative, So I applied for anticipatory bail. But in court wife came with advocate & oppose bail so my bail is rejected. Now I applied in high court for bail & I am on interim bail. After grant interim bail to me suddenly wife came with her father & thrown acid on me. Now I am in hospital. So whether I have permission to file FIR for Acid attack? Which IPC will be apply?

Without any thoughts you should have filed an FIR and there should have been no delay. also in the MLC the hospital staff may have written about how you recieved such injuries and the police would have come to you and asked you in detail. if you had lied then, you have spoiled your case. Also in 498A the new law is that there cannot be any arrest please refer Arnesh Kumar vs State of Bihar judgement wherein the Supreme Court has given a landmark judgment. Also when some policemen arrested in contempt of the judgment, were sent to jail.

You must lodge an FIR against your wife u/s 326A Indian penal code. The said section awards punishment for minimum 10 years along with fine. If MLC or any other evidences corroborate with your allegations, seek divorce on grounds of cruelty.
