Married a colleague now mentally harassing and threatening false case

22-Oct-2023 (In Divorce Law)
Sir/Ma'am My brother is serving in IAF and he married his colleague in court. Later she started torturing him physically and mentally and threatened him of filing false dowry case against my family. She wanted divorce but when it comes to signing the papers she refuses. My brother complained to his seniors about all this and they suggested them to live separately. Now the girl using her connections with some high authorities has started putting pressure on him and even stopped his sorties. My brother now has no other option but to remarry her socially to get back to his flying. My family doesn't want the girl to come into his life again because if this happens then even if she comes home for a day she can blame us of false charges. Till now neither she nor her family members have any proof against us as the two families have never met. Nor we have ever asked for anything. please help us..

Maam in order to give you a right suggestion I would like to know when did he get married is he having any issues or not and what are your specific allegations towards his wife for now on he can file a contested divorce application before a civil court.

It is important to know where did this marriage solemnized? It will be better option if you prefer for annulment of marriage. The court will see into all the factors presented before it before passing an order for annulling the marriage, the court has to be convinced the reason for non-consummation of marriage as per law, then only the court will be able to pass order accordingly. It is not a mutual consent divorce that the respondent will agree to the terms of the petition and the court will pass order accordingly. If she agrees for breaking the marital ties legally, she has to give her consent for divorce on mutual consent grounds alone and not under section 12 of HMA.
