Marriage 8 years , sons age 7 how to get divorced

 Periods of my married life is 8 year,I have the only son of aged 7. Since the time of marriage my relationship with my wife is not good. She is at her parents home since February, along with my son.She blame me that I have an extra marital affair which she could not proof. I want divroce from her because she is psychological case.and doubt on me without any reason. How can I get divorced at the earliest.She will not like to divorce me as I know her.

As cruelty is a ground for divorce under different laws, in order to get rid of the marriage wife use this section as a powerful weapon against their husband. ... Section 13 of The Hindu Marriage Act, 1955: Under section 13 of The Hindu marriage act, cruelty is a ground for divorce.

First of all i suggest both of you may approach good family councillor and see if both of you can resolve your disputes. you may also talk about mutual consent divorce. if you are unable to resolve the disputes. you may only file divorce if your case is covered under any of the following ground Adultery, Cruelty, Desertion, Conversion, Unsoundness of mind, Schizophrenia, Virulent and incurable leprosy if both of you are Hindu by religion. You may further consult a lawyer to help you in this regard.

You will have to file a case of divorce in the court having jurisdiction in you matter. You will have to prove one of the grounds of divorce. Further opinion as to on what grounds you can file for divorce can be determined only after knowing the full facts of the case.
