Dear Client, 1. You cannot simply avoid a maintenance order, but you can challenge it legally. File an appeal or modification petition before the higher court showing valid reasons—such as your low income, her sufficient earnings, false allegations, or change in circumstances. If the wife is earning well or capable of maintaining herself, the court can reduce or cancel the maintenance. Until the order is modified, you are legally required to pay to avoid arrears, penalties, or warrant. 2. Consult an advocate to discuss your case in brief. 3. A maintenance order passed by the Family Court cannot be avoided without following proper legal procedure. However, you can challenge it before the High Court under Section 19 of the Family Courts Act if the order was passed without considering your financial capacity, your actual income, your liabilities, or if there are strong grounds to show that the spouse is earning independently. You may also seek modification or reduction of maintenance by filing an application before the same court by producing proof of your financial hardship, unemployment, medical expenses, or other genuine constraints. Avoiding or non-payment may lead to execution proceedings, including warrant or attachment. The proper remedy is to challenge or seek variation of the order through legal process.
