Maintenance case, clarification required
11-Jun-2025 (In Divorce Law)
My wife left me few years back and living with her father. She applied for Maintenance. While she was leaving she left around 3 sovereign gold jewellery in my house and claims it now. The marriage expenses were met by me alone about 10 lakh rupees. Can I keep the 3 sovereign in liew of marriage expenses by me. I am ready to live with her but she refused in all forums to live with me. Please advise.
Legally, the gold jewellery left behind by your wife in your house is her stridhan—her absolute property. You cannot legally hold it back to offset marriage expenses. Courts generally require that you return such items on demand.
If she files a complaint, you could be ordered to return the jewellery. Marriage expenses are usually considered voluntary and not recoverable.
I recommend consulting me directly for a tailored legal strategy. Let’s discuss how best to approach this matter in detail.
