If the e-Courts online app shows the status “Notice Issued”, it generally means that the court has directed that a notice or summons be issued to the opposite party and that the process of service is either pending or underway. Merely seeing “Notice Issued” in the case status does not mean that you have been proceeded ex parte. An ex parte order is passed only when a party, despite being duly served with notice/summons, fails to appear before the court and the court specifically records an order to continue the proceedings in that party’s absence. Such an order is usually reflected in the court’s order sheet with expressions like “proceeded ex parte” or “case to proceed ex parte against the respondent/defendant.” Therefore, the fact that you did not attend the first four hearing dates does not automatically mean that you have become ex parte. Whether an ex parte order has been passed depends upon several factors, including whether notice was properly served upon you and whether the court has actually recorded such an order. To ascertain the correct position, you should check the Daily Order Sheet, Orders, or Proceedings section available on the e-Courts portal or app. You may also obtain a copy of the latest order from the concerned court through your advocate or from the court registry. If the order sheet reveals that an ex parte order has indeed been passed against you, it may still be possible to seek its setting aside by filing an appropriate application and explaining the reasons for your non-appearance. Hence, the decisive document is the court’s order sheet, not merely the “Notice Issued” status displayed in the app.
