Living separately with 1 year old son can husband ask for custody

me and my husband are staying away for more than a year, for the reason that he did not want to go for a job and was not taking any responsibility and was a hard core drinker. i have a kid of 7 years old who wants to stay with me and not with the dad as he has seen his father drinking and creating scenes at home.but now my husband sends me a message daily asking for my son..what should i do now?
Dear Querist,
If u r husband is a drinker and is unable to be reformed inspite of undergoing de addiction programme u must think of filing a divorce petition. In any event, you don't have to send the kid to u r husband as he may not be able to take of the kid, it shud be more of threat & harassment. However, u can give him visitation rights as he is the father of the child but ensure that he does'nt misuse the oppurtunity.
