Legal solution for my issues in marital life
21-Nov-2024 (In Divorce Law)
I got married just 5 months before. My wife is not affectionate on me and her family is influencing her in a bad way to collapse my family's peace. They want me to behave as per their instructions. They are even discussing my properties among themselves. I feel very stressful and unsafe to lead my life with her. What should I do now? Can I file a divorce petition? Will I need to give maintenance/compensation?
Thank you for reaching out with your query. Based on the details provided, it appears that you are experiencing significant challenges in your marriage and are considering legal action. Allow me to address your concerns:
1. Filing for Divorce: Yes, you can file for divorce under the Hindu Marriage Act, 1955, or relevant personal laws, citing mental cruelty or any other applicable grounds. Since the marriage is only 5 months old, courts may advise exploring reconciliation or mediation before proceeding further. However, you are entitled to file a divorce petition if you believe the relationship is untenable.
2. Maintenance/Compensation: Whether you are required to provide maintenance or compensation will depend on various factors, including your wife’s income, financial dependency, and the court’s decision. If your wife is unemployed or financially dependent on you, she may claim maintenance under Section 125 CrPC or relevant provisions.
3. Property Matters: Your wife or her family does not have any direct rights over your self-acquired property. However, it is important to ensure that no undue influence or coercion is being exerted upon you.
Next Steps:
• Document all instances of harassment or coercion, as this evidence may strengthen your case.
• Consult with a legal professional to draft and file the appropriate petitions, whether for divorce or for restraining undue interference in your property matters.
• Explore options for mediation or counseling if there is any possibility of resolving the issues amicably.
