Legal advice regarding mental cruelty after court marriage

16-Dec-2025 (In Divorce Law)
My brother-in-law and his wife had a court marriage without informing parents. Later they lived with his parents. The wife (working nurse) continuously pressures him to leave his parents and stay at her parental home, makes derogatory comments about his mother, and has frequent verbal arguments with his father. He is willing to live separately but not abandon parents. Does this amount to mental cruelty? What evidence is needed, safest legal steps, and how to protect against false cases? How wil

Under Section 13(1)(ia) of the Hindu Marriage Act, 1955, mental cruelty includes conduct that causes mental pain, agony, or makes cohabitation unreasonable. Courts have repeatedly held that the following may constitute mental cruelty if persistent and serious: Constant pressure to sever ties with parents Insulting / derogatory remarks against spouse’s parents, especially mother Frequent verbal abuse or humiliation of elderly parents Creating a situation where the husband is forced to choose between wife and parents Continuous quarrels creating mental stress and loss of peace
