Is it possible to get annulment for a muslim marriage if it's been less than a year in case of mutual consent or does one have to file for divorce. Does the couple need to apply in court given the new supreme court judgement against triple talaq or they can do it with witnesses. Also can both of them get married again to other people without any waiting period or is it essential even when done with mutual consent
Yes muslim marriage can be annulled. Unlike Hindu marriage act, there is no waiting period of one year. In light of the SC judgment, yes you will have to apply in court for dissolution if you want it in one go, else with witnesses if it is over three months. Iddat is an essential part of the Muslim marriage and you will have to wait before re-marriage.
