If a false Domestic Violence (DV) case has been filed against you in her district, then you are required to defend that case before the court having jurisdiction in her district, because under the law a DV complaint can be filed where the woman resides or has resided. However, from your own district you can initiate independent proceedings against her if you have evidence that she has filed a false case with malicious intent. Remedies available include filing a civil defamation suit claiming damages for loss of reputation, or initiating a criminal complaint for offences such as filing false information, false evidence, or malicious prosecution. These can be filed in your own district court provided the cause of action (such as damage to your reputation) arises in your district. As for quashing the DV complaint, the proper legal remedy is to file a petition before the High Court under its inherent powers (previously Section 482 CrPC, now under Bharatiya Nagarik Suraksha Sanhita, 2023) seeking quashing of the proceedings. The High Court may quash the DV complaint if you can demonstrate that the allegations are false, baseless, absurd on the face of the record, or that the proceedings are an abuse of the process of law. Courts generally quash such complaints where the complaint is filed with mala fide intention to harass, without any prima facie evidence of domestic violence.
