Under Section 9 of the Guardians and Wards Act, 1890, which governs child custody matters in India: If the application is with respect to the guardianship of the person of the minor, it shall be made to the District Court having jurisdiction in the place where the minor ordinarily resides. So the father has to file a case in District Court Bolpur

Under Section 9 of the Guardians and Wards Act, 1890, a child custody petition must be filed in the district court where the minor “ordinarily resides,” meaning the child’s actual place of residence and not the parent’s residence; therefore, since the child is residing in Bolpur, Birbhum, the proper jurisdiction lies with the District Court there, and the father cannot legally maintain a custody case in Bihar merely because he resides there—if he does, the mother can challenge it at the threshold for lack of jurisdiction.
