Dear Client, In Mutual Consent Divorce under Section 13B HMA, if both husband and wife have already settled alimony and custody, the Court normally does not ask for income proof. Since it’s not a contested case, income details are usually unnecessary. However, if the Judge feels the settlement is unfair or child’s interest is not protected, the Court may still ask for documents. But in practice, income proof is generally not required. Warm regards, Adv. Gurjant Singh

Hello, In a mutual divorce, there is no requirement to submit income proof before the court. Since the divorce is based on the mutual consent of both parties, all matters relating to alimony, maintenance, and custody of children are already amicably settled between them. Therefore, the court does not demand income proof in such cases.

No the court does not ask for any income affidavit or proof of income in a mutual consent divorce case, if the settlement on alimony and custody both are already agreed there is no need for income affidavit to be given on record.
