So what I understand is that you have been falsy implicated in some criminal cases and you want custody of the child. firstly, you need to clear whether any divorce proceeding is pending, the age of the child and where she resides. Definitely the father has the right to seek custody and visitation of the child. you have to file an application seeking custody of the child with visitation rights.

From the facts stated by you, the filing of a case under Section 498A and attempt to murder does not automatically take away your parental rights. The primary consideration of the court in child custody matters is always the welfare and best interest of the child. You have the legal right to approach the Family Court under the Guardians and Wards Act for custody or at least visitation/joint custody of your daughter. Even if the child is currently with the mother, the court can grant you visitation rights or shared parenting if it finds that maintaining a relationship with the father is beneficial for the child. Regarding the criminal allegations, you should immediately consult a criminal lawyer to seek anticipatory bail and properly defend the case if the allegations are false. The outcome of the criminal case will not automatically determine custody; both matters are considered separately by the court. You may therefore initiate proceedings for joint custody or visitation rights before the competent Family Court, presenting evidence that you are capable of providing a stable and supportive environment for the child.

Since your wife has filed cases under Indian Penal Code Section 498A and Indian Penal Code Section 307, you should immediately consult a criminal lawyer to defend the case and seek appropriate bail if required. For child custody, you can file a petition in the family court seeking joint custody or visitation rights under the Guardians and Wards Act, 1890. The court will decide based on the best interest of the child, so you should present evidence showing your involvement and ability to care for the child.

I understand that you are going through a very difficult situation, especially with serious allegations being made and at the same time concerns regarding your child’s custody. Please be assured that the law always prioritizes the welfare of the child, and as a father, you have a strong legal right to seek custody or at least joint custody/visitation. In your case, you can approach the appropriate Family Court under the Guardians and Wards Act seeking custody or joint custody of your daughter. Even if full custody is not immediately granted, the court can certainly provide you with structured visitation rights or shared parenting arrangements. The fact that you have been in contact with your child and are willing to take responsibility will work in your favor. Regarding the criminal allegations, those proceedings will run separately, and it is important to handle them carefully as they may have an indirect impact on custody proceedings. A proper legal strategy is required to defend those allegations while simultaneously strengthening your position as a responsible parent. I have been handling matrimonial and custody-related matters for the past few years, including cases involving false allegations, 498A disputes, and child custody battles. I assist my clients in building a strong case for custody while ensuring their legal rights are fully protected on all fronts. These matters require a very strategic and balanced approach, as both criminal and family proceedings are involved. I can guide you step-by-step to secure your rights as a father and work towards the best possible outcome for you and your child. You may consult with me to discuss your matter in detail. The case lodged by your wife requires substantial evidence to prove the offences against you. Without alifd evidences the ase will be dismissed if you can submit evidences in your favour. If your daughter is minor, she will be in her mother's custody on some condition directed by the court after judicial separation or divorce.
