before answering your query, something needs to be informed. who filed the petition, on What grounds, what is the status of the otherside, the stage of suit and where is it pending. otherwise it would not be proper to advice on this point.

Yes, you can withdraw your divorce petition even without the consent of the opposite party, but it depends on the stage of the case and the type of relief sought. Here is the legal position under Indian law: Withdrawal of Petition – General Rule Under Order XXIII Rule 1 of the Code of Civil Procedure, 1908, a petitioner (plaintiff) has the right to withdraw the suit/petition at any time. Since a divorce petition is a matrimonial proceeding, courts generally allow withdrawal if the petitioner no longer wants to pursue the case. Consent of the opposite party is not required if you simply want to withdraw the petition without liberty to file a fresh one.

Yes, it is legally possible to withdraw your divorce petition even if it is a contested matter, and importantly, consent of the other party is not required for withdrawal of your own petition. You may file an application before the same Family Court seeking permission to withdraw the petition. Generally, courts allow such withdrawal as it is the petitioner’s prerogative. However, if the case has reached an advanced stage (such as evidence or final arguments), the court may impose certain conditions or costs. Do note that once withdrawn, filing a fresh petition on the same cause of action may require the court’s permission. Therefore, it is advisable to clearly mention whether you seek liberty to file afresh in future. Also, if there are any counterclaims, maintenance proceedings, or other connected cases filed by the opposite party, those will continue independently despite withdrawal of your divorce petition. I would strongly recommend taking a strategic call before withdrawal, considering settlement possibilities, legal consequences, and future rights. Proper drafting of the withdrawal application is crucial to safeguard your interests.

If you have filled the divorce suit, then of course you can withdraw your case at any time on reasonable ground without having consent from your husband, the defendant. Because you didn’t take any consent from him at the time of filling. You can also compromise with him by an amicable settlement.
