Yes, it is possible to withdraw your divorce petition even if the case is contested. The petitioner has the right to file an application before the same family court seeking permission to withdraw the petition. Generally, the court allows withdrawal if the petitioner clearly states that they no longer wish to pursue the case. Consent of the other party is not always mandatory for withdrawal of your own petition. However, if the respondent has already filed any counter-claim or independent relief, the court may consider those aspects before passing an order. You should file a formal application for withdrawal through your advocate before the family court where the matter is pending. The court will hear the parties and may allow the withdrawal with appropriate liberty, if applicable. Since every case depends on its stage and facts, it would be advisable to examine the case file and the stage of proceedings to guide you on the best course of action.
