If despite opportunities, petitioner: Does not file chief affidavit Does not produce witnesses/documents Then you can move an application to Close the petitioner’s evidence If petitioner is Absent repeatedly or not pursuing the case seriously you can seek dismissal under: Order IX Rule 8 CPC (in appropriate situations)

The question is vague in its nature. If the petitioner already filled a case, then why is he taking adjournment? And if the respondent has various evidence, then why are those not submitted? There must be a missing link...let be cleard first.

Please file a case for expeditious disposal if your other side is taking unnecessary adjournments to prolonge the case. You may file it before the High Court of your state. Once filed, the court may give directions so as to expedite the litigation. with regards.
