How to prove mental cruelty in divorce?

I was married 2 yrs back but my wife still does not want to get into any kind of physical relationship with me. A few months back when I asked her the reason for her denial, she left my house and went back to her parents place and has not returned for 6 months now. Despite of my constant efforts she has refused to return. What can I do?

In case you want a divorce, you can file a petition on the grounds of mental cruelty, in the district family court. You will be required to collect evidences to prove your wife’s denial to get into any kind of physical relationship with you or was also not living with you for a period of six months. If your wife agrees for the divorce you can file for a mutual consent divorce but if she refuses you will have to file for a contested divorce. In case you go in for a contested divorce it is best to legal advice from a well experienced lawyer.

But in case you want to continue with your marriage, you can approach the court with a petition for restitution of conjugal rights.
