How can father get the custody of his son

24-Jul-2025 (In Divorce Law)
My wife took my son from me when he was 3 and half years old. She is staying now in her maternal home with my son. She also does not allow him to come to my home for a single day so every Sunday I visit to see my son. What ever she is doing is forcefully taking the benifit of being mother although I bear every expenses of my son. I don't know What to do in this situation so that I get back my son and also if she wants to stay with me in my home she is always welcome.

In India, child custody matters are governed by various personal laws and the Guardian and Wards Act, 1890. The paramount consideration in all custody disputes in the welfare of the child. You can file petition for child custody and visitation rights in the appropriate court. While you are bearing all the expenses, it can be presented as evidence of your commitment to your child's well-being. Your willingness to welcome his wife home is a positive step towards potential reconciliation . Mediation or counselling services you can explore to facilitate communication and explore the possibility of resolving the matter out of court.
