Help to avoid/reduce manitenance.

20-Aug-2025 (In Divorce Law)

I'd filed for divorce @ Faridabad in Feb'23, while it got transferred to Saket in Sep'24. Till then, no WS received from wife. Now, she gave her first WS on 15th July and asked for maintenance for child. We have a 4 year old daughter staying with her. I was working till Jun 24 but lost my job thereafter, and till not found it, due to high experience, though still searching. She is working in HCL at a high position. I've been asked for maintenance of 50k in Saket court. Request help

Hello, In maintenance cases, both parties are required to submit their income affidavits and bank statements for the last three years. If you are currently unemployed and your wife is earning, there is little likelihood that you will be directed to pay maintenance to her. However, the expenses of the child will have to be shared equally by both parents. I will be able to guide you more accurately once I have the complete details of your case.

Decrease in income (job loss, salary cut, health issues preventing work). Increased expenses (medical bills, dependent care, etc.). Change in recipient’s situation (if the person receiving maintenance gets a better job, remarries, or becomes self-sufficient). Shared custody or change in living arrangements (in child support cases).
