Harassment by daughter's husband now he married again without divorce

08-Nov-2023 (In Divorce Law)
Hi, My daughter got married to a NRI engineer in March,2013. But she stayed with her husband only for 20days. Post that she has filed a divorce case against her husband in 2014 March on grounds of dowry harassment by the groom. The case is still pending in court due to non cooperation from groom's side. Meanwhile we got to know that the groom married one more girl in april 2016. I have the recorded conversation of the second wife and her mother as proof. Please guide me if I can register a police complaint against the groom and his family? and also tell me if the police is bound to take legal actions against the groom and his family?

Hi,
Second marriage is a criminal offence, without getting the decree of divorce. Your daughter can lodge an FIR and can take legal action in this situation. Please feel free to contact for more detailed advice.

Dear madam if your daughter is a Muslim then there is no any legal embargo for second marriage but if your daughter is a Hindu then she can file a case of polygamy in the local police station according to jurisdiction of the place of marriage or lastly were she is or has resided with her husband as her divorce case is pending that will not make any hindrance to the criminal case.

without proper divorce getting married is criminal offence and you can surely take legal action . another point is the case you daughter has initiated you should press to get that moving . But you should not act on hearsay and have sufficient evidence.
