Friend married again before getting divorce. What are his options ?

06-May-2023 (In Divorce Law)
Dear Lawyer,Greetings of the day!!! This mail is to seek legal advice for my friend. Though I have a detailed brief of the case written, I am sending you a brief as it’s not possible to send the same across the website. To be concise, my friend is a 40 year male who has been married since 2007. He has a daughter aged 6 plus years and his divorce, maintenance, and 498A case is being heard in the law courts of Alipore,The turnaround in the case came when he married a divorced girl in 2015. This girl married him despite knowing that he was yet to get a formal divorce from his first wife. Later on she sent a mail to him stating that she had married just for money. Due to the tortures, my friend and his mother left their house leaving the behind. Is it possible for the girl to file a case on my friend since he has already a divorce case on? Is it advisable to patch up with the first wife to negate complications? Will the mail act as a proof of the girl’s evil motives?

First of all it will straighly be a case of polygamy. Second marriage as per Hindu marriage act is null and void. Your friend can take the plea that she forced her to marry despite telling her that his cases are pending before hon'ble courts.

Hello, in this case your rights are intact and case is also intact. Do not worry as a Legal wife you are entitled for alimony, maintenance etc and second marriage is void ab initio. And it has no standing in the eyes of law.
