Forced Marriage & Divorce Concern

09-Oct-2025 (In Divorce Law)
My marriage was done against my will. Before the marriage, I had clearly informed my wife that I did not want to marry her and that my family was forcing me into it. I have evidence to support this. I am not happy in this marriage and it has now been more than 1.5 years. My mother completely controls my life and decisions, and I feel like I have no freedom. I want to file for divorce, but my wife is not agreeing. My family and my mother’s relatives are putting continuous emotional pressure on me to stay in the marriage. I need legal guidance on how to come out of this forced marriage and live independently.

Hello, In your situation, you can file for divorce on the ground of cruelty, considering the continuous emotional pressure and lack of freedom you’ve described. Alternatively, if you are able to convince your wife, you may also opt for a mutual consent divorce, which generally takes much less time and is simpler to conclude. I would be able to guide you better after knowing the full details of your case and appreciating the evidence you have to support your claims regarding the forced marriage and subsequent treatment.

If your marriage was done against your will you can file for a divorce if the court of law. If you are unhappy in a marriage and you are being put under continuous emotional pressure you will have to make both your mother and your wife to understand that you don’t want this. You can also sit for mediation with a court appointed mediator to end this amicably. You may get in touch with me to discuss this and I will guide accordingly

You have a valid ground to seek divorce under Section 13(1)(ia) of the Hindu Marriage Act, 1955 on the ground of mental cruelty. Forcing a person into marriage against his free will and continuing emotional pressure thereafter amounts to cruelty. Even if your wife does not agree for mutual consent divorce, you can file a contested divorce petition before the Family Court at your place of residence. Mention in your petition that the marriage was performed under pressure of your family and you were never willing to cohabit as husband and wife. Attach any available proof (messages, witnesses, or written communication) showing that you were unwilling for this marriage. You can also mention emotional and psychological harassment due to family control as mental cruelty. If your wife creates pressure or files false complaints, you may seek protection under law and apply for anticipatory bail if required. You can also live separately and file for judicial separation first, if you are not yet ready for divorce.
