Exemption for Personal Appearance Tendering as going for job to USA.

I am going US for long time on job. My ex parte divorce evidences case is pending for 2-3 years since every time court says that no time for evidences tendering as lots of cases pending. Can I request the court for exemption from my personal appearance for evidences tendering in such case?

The laws of India do not allow a divorce to be granted in absentia. Therefore, the Parties must appear before the Court on the relevant dates for the divorce to be granted. While you may not be required to appear on every given date, evidence will have to be tendered by the person deposing in person.

You may however, execute a power of attorney in favour of a friend or relative who may appear on your behalf when possible and further sign all documents and do such acts and things as requried to pursue your case.
