Ex-parte divorce in 6 months time

19-Jul-2025 (In Divorce Law)
I recently did a Hindu registered marriage in Coimbatore on July 7. Immediately afterwards the girl expressed lack of interest and stated that she was forced to marry me by her mother. We created an MoU confirming our intent to divorce the very next day on July 8. Now my lawyer is saying that the best way to divorce is by letting them file a contested divorce. He asked me to be absent during the court hearing to allow the court to grant an ex-parte divorce within 6 months. Will this work?

hi, I can well understand your concern from the query raised, such practices won't be entertained by the court , you both can apply for a mutual divorce, that would expedite the matter and grant you divorce, thank you

In your case, since the marriage was registered under the Hindu Marriage Act and both parties signed an MoU expressing intent to separate, the most appropriate and legally secure route is to file for mutual consent divorce under Section 13B. Your lawyer’s suggestion to let the girl file a contested divorce and remain absent for an ex-parte decree may work, but it carries risks—the court may dismiss the case, delay proceedings, or pass adverse orders. An ex-parte decree can also be challenged later. Mutual consent divorce is faster, cleaner, and enforceable, especially since there's no dispute and both parties agree. You should insist on mutual consent if she is willing, and only consider other options if cooperation fails. Advocate Arjun Saravanan Rajendra Law Office LLP
