Dowry and Abusement,Restircted to matrimpnial house without non paymen

16-Sep-2026 (In Divorce Law)
Need advice for a DV/Dowry case against FIL & BIL, who evicted me demanding ₹40L for my husband's 'MBBS education'. Their torture caused my miscarriage (Oct'23), and I have UP-112 records of BIL's threats (Aug'26). My biggest strengths: my husband fully supports me as my main witness, and FIL gave a written IGRS police admission demanding this money. With this written confession and my husband's support, my maternal is kasganj, matrimonial is jaunpur

Based on the evidence you hold, you have a strong legal case under both criminal and domestic violence laws. You can immediately file a criminal complaint/FIR under Section 85 (Cruelty) and Section 108 of the Bharatiya Nyaya Sanhita (BNS) along with Section 3/4 of the Dowry Prohibition Act against your FIL and BIL, citing the IGRS admission of the ₹40L demand and UP-112 threat records. Additionally, file an application under Section 12 of the Protection of Women from Domestic Violence Act (PWDVA) before the Magistrate to claim protection orders, monthly maintenance, medical compensation for the miscarriage, and residence rights. Your husband's testimony as a direct witness will be crucial in proving the torture and eviction. You can file these proceedings at your current place of residence (Kasganj) under Section 27 of the PWDVA for your convenience.

Based on the facts you have provided, you possess an exceptionally strong legal case, primarily due to the written IGRS admission and your husband’s full support. The ₹40 lakh demand for his MBBS education, coupled with the eviction and the trauma leading to your miscarriage, clearly constitutes cruelty and a dowry demand under the Protection of Women from Domestic Violence Act, 2005, and Section 85 of the Bharatiya Nyaya Sanhita (formerly Section 498A IPC). Your husband serving as your main witness is your greatest asset, as it neutralizes the typical defense that the allegations are fabricated matrimonial disputes. The UP-112 records from August 2026 further corroborate the threats made by your brother-in-law, establishing a pattern of intimidation. Since your matrimonial home is in Jaunpur and your maternal home is in Kasganj, you have the legal option to file the case either where the cause of action arose (Jaunpur) or where you currently reside (Kasganj). Given the gravity of the written confession, you should immediately file a domestic violence application seeking protection orders, residence rights, and monetary compensation, alongside a criminal complaint for dowry harassment. Do not delay, as the IGRS admission is a powerful piece of evidence that explicitly proves the illegal demand. Consult a local advocate in either jurisdiction to draft the petition, ensuring you attach all medical records of the miscarriage and the UP-112 logs to maximize the impact of your case.
