Divorce alimony mutual settlement
10-Feb-2026 (In Divorce Law)
If Hindu unemployed childless wife after 3 year separation wants divorce with permanent onetime amount of 40 lac n no future maintenance, can court grant her that if divorce case with maintenance filed? or is it advisable to settle at this amount mutually if husband salary is 55000 per month and no other assets other than parents house in their will? What amount is reasonable in this scenario to mutually divorce?
Yes, the court can grant a one-time permanent alimony if both parties agree in mutual consent divorce. Once you accept a full and final settlement and waive future maintenance, you generally cannot claim again later.
With a salary of ₹55,000 per month, ₹4 lakh is possible but may be on the lower side. Settlement amounts are usually calculated considering income, duration of marriage, and financial security.
If both are willing, mutual settlement is faster and advisable, but the amount should be fair for your long-term stability.
