Agar aap dono ne ₹80,000 me aapsi sahmati se talak lene ka faisla kiya tha, to us samjhaute ko court ke samne prastut kiya ja sakta hai. Lekin Mutual Divorce dono pakshon ki sahmati se hota hai. Agar patni ya uska parivaar sampark me nahi hai, ya court me prastut nahi ho rahe, to Mutual Consent Divorce file nahi ho payega. Aap apni taraf se contested divorce file kar sakte hain – cruelty, desertion, ya jhoothi maangon ke grounds par. Maintenance ke mamle me, agar patni aarthik roop se saksham hai, to court usse maintenance dene ke liye majboor nahi karega. Aapki aamdani kam hone, aur unki financial position behtar hone ki sthiti ko court zaroor dekhega. Apni sthiti court me pramaan sahit prastut karen.

Contested Divorce File Karein Agar patni divorce ke liye cooperate nahi kar rahi, to Section 13 Hindu Marriage Act me contested divorce file karein. Grounds: Mental Cruelty, Desertion, Financial Exploitation. Step 2: Court Me Apna Financial Affidavit Jama Karein Court ko batayein ki aap ₹5000 per month kamate hain, aur maa par dependent hain. Apna bank statement, salary slip, kiraye ka kagaz court me dikhayein. Step 3: Maintenance Me Relief Maangein Court me affidavit ke zariye low income ka proof dijiye. Aap maintenance me reduction ya exemption maang sakte hain. Step 4: Legal Cruelty Ka Mention Karein Divorce petition me likhein ki aapse ₹80,000 lene ki baat hui thi, aur yeh mental pressure create karne wala tha.
