Court Summon U/S 13 of the Hindu Marriage Act

Respected Sir, I Ankit, a resident of Pune (Staying here for job purpose) got married a year ago to my Spouse from Nagaland a year ago i.e in the month of April 2016. In the month of January (i.e 27th Jan 2017) I was Diagnosed with a Chronic Kidney Disease (ESRD last stage) and was admitted to an hospital, currently under dialysis twice a week. Sir, after a month my wife left for her house stating reason for a change. After few days she stopped talking to me and to my surprise I received Court Summon U/S 13 of the Hindu Marriage Act. kindly note, My marriage is yet to be registered. Sir, I have currently herd (on the basis of some conversations recorded with one of her relatives that she is spreading this news that I am an impotent and I am at last stage of the Dialysis and wont be alive any further. I beleive my disease is the only reason for the divorce. Sir, kindly let me what all options am I entitled to and my tenure of punishment in this case.

If you want to go habit with your wife then you have to file a petition for restitution of conjugal rights in the family court of Pune as well as you have to proceed also with the matter file by your wife
Initially we can send the notice for restitution of conjugal rights to your wife

In this case it is very important for you to understand what is pleaded by her in her petition and it is advised that you should attend / respond to the case before court. It will bring your side before court.

If she has filed divorce u/s. 13 of the Hindu Marriage Act, then she must have planned something for her, therefore you are this stage. Further the grounds (Impotency) if she is taking that support for the same, then their will be also question of Maintenance. In this proceedings you are not going to get any punishment only you will be ordered if the court think fit to direct you for her maintenance whether permanent or temporary totally depends on the Court. Therefore you need legal assistant and also further litigation help. please call on my number.
