court mein taya hone ke baad bhi divorce ki prakriya slow

07-Mar-2026 (In Divorce Law)
district court mein 3 motion mein alimony fix hone ke baad bhi wakeel dwara delay kiya jaa raha hai. 1st motion joki family court mein hua, par 2nd motion mein 8 month delay ho gaya. 2nd motion par opposite party ko apna case wapas lena tha aur court mein submit karke 2nd motion ke tahat taya rakam hame dena tha. Opposite party ka wakeel delay kar raha hai pichhle 8 month se kah raha hai is week ho jaayega. Disctrict court mein judge ne ek baar hamare wakeel ko questioning ke liye bhi kaha tha.

Agar first motion mein alimony amount aur settlement terms already decide ho chuki hain aur uske baad bhi opposite party ya unke vakil bina kisi valid reason ke second motion ko delay kar rahe hain, toh aapke vakil court se unnecessary adjournments par cost impose karne ki request kar sakte hain. Family Court generally aise cases mein, jahan matter settlement stage par ho aur phir bhi delay ho raha ho, opposite party ko warning de sakti hai ya cost laga sakti hai kyunki isse court ka time waste hota hai aur dusri party ko unnecessary harassment hoti hai. Aapke advocate court se yeh bhi request kar sakte hain ki second motion ke liye ek final date fix ki jaye aur opposite party ko direction di jaye ki woh us date par appear ho kar settlement terms follow kare. Agar phir bhi delay kiya jata hai, toh court appropriate orders pass kar sakti hai.

The eight-month delay in the second motion of your mutual consent divorce is a serious procedural issue, especially if the alimony and terms were already finalized during the first motion. Since the opposite party and their counsel are tactically stalling the submission, you should request the Family Court judge to intervene directly or move an application to expedite the proceedings

Aap apne advocate ke through court mein ek early hearing ki application file kar sakte hain jisme mention karein ki 2nd motion already delay ho chuka hai aur opposite party jaan-boojh kar delay kar rahi hai.
