03-Aug-2023 (In Divorce Law)
My brother wants to divorce and the wife can ask for alimony against his property but my parents are senior citizens and hold a 50 % share in the property. Can they be removed from the house to pay the alimony.. the brother's wife is working in a reputed school and stays with parents.

This is my response to you:
1. The wife can claim alimony to the extent of her husband's share;
2. The Wife can ask for the alimony depending on the value of assets and liabilities of the husband;
3. The senior citizens will not be removed from the proeprty;
4. Try to refute all the charges laid down by wife;
5. Show evidence as to how less income you have and you cannot afford to pay alot;
6. Also state that you have loans, liabilities and have to look after your aged parents.
