Can court allow Divorce decree to the husband alone?

Hi, My name is Navneet Kaur. We have filed Mutual divorce on 21st feb, 2025 under Hindu Marriage Act. Our First statement has been recorded and our second motion hearing will be in August. I am not taking any Alimony. Now, I have two questions:- 1. If I do not attend the second motion hearing so can my husband take divorce? 2. Can i go to abroad without Divorce Decree?

Yes You would need some documents along with that you are going to abroad If you Really want to Clarify things You may contact me on my whatsapp or through call I will explain it to you that how can you take divorce from your husband in second motion without your appearance you may need some documents or some authorised person on behalf of you can sign instead of you

if u r not willing to attend second motion. ur husband has an option to file Another petition of contested divorce and then he can get Ex-party divorce. if you are willing to attend second motion but not able to attend. than you have an option that you can issue special power of attorney of another family member who can attend proceeding on ur behalf.

Hy Navneet Kaur ! It is not advisable to not attend the court hearing on second motion to be held in August. however if u don't want to pursue the divorce you can deny signing the second motion and withdraw from the proceedings. Coming to ur second question, Yes you can go to abroad without a divorce decree but consult me before hand for detailed discussion about your plans .
