BNSS 144 Maintenance: IA for Expense Proof & School Change Without Int

12-Apr-2026 (In Divorce Law)
I am respondent (party-in-person) in a child maintenance case under Bharatiya Nagarik Suraksha Sanhita Sec 144. Wife filed DV in Jan 2025 (stayed, no maintenance), then BNSS 144 in Nov 2025. In between, she changed child’s school (₹75k to ₹3L/year) without informing me and claimed high expenses without proof. Should I raise in objections or file IA? If IA, under which section to seek proof and prior intimation?

File detailed objections first denying inflated claim. Simultaneously file IA u/s 348 BNSS r/w Sec 165 BSA seeking direction to wife to produce school fee receipts, bank statements and prior intimation proof. Burden lies on claimant to prove expenses.
