At what stage application under section 151 cpc can be filed?

My husband has filed a second divorce petition on the same cause of action as it was in earlier divorce petition which got dismissed on merit. I just wanted to know that if I go for quashing of this second suit on the basis of resjudicata then at what stage application under section 151 cpc can be filed? Should I file my written statement first and then file application under section 151 cpc or without filing written statement I can directly file application under section 151 cpc for quashing.

At first stage by showing the earlier order and file an application order VII rule 11 for dismissal of plaintif and other party May file reply and argument will be there for further information and details please free to contact
