Alimony in case of working wife husband earning more dv case filed
26-Jul-2023 (In Divorce Law)
I have filed cases of DV (no relief has been granted till date by Court) as well as divorce on basis of cruelty after constant physical, mental and verbal abuse by my husband and in-laws. Now he is saying that he will not give any money as I am also working and he is OK with divorce without giving me money. I wanted to know that whether I be eligible for maintenance/alimony and how much as I am also working but my husband is earning more (double) than me. Its been 1.5 years since we got married and I left matrimonial house after 6 months of staying together. I am Hindu by religion, working and residing in Mumbai.
Look there are many recent judgments which have ruled that a qualified wife who is capable of earning is not entitled to get maintenance. Maintenance is payable during the pendency of proceedings while alimony is payable as compensation for divorce by husband. Though you are not entitled to maintenance nothing says you cannot get alimony at the time of divorce. Please contact with further details so that we can guide you specifically based on the facts of your case.
Dear client if u prove yr case in court then u will get alimony in divorce. U have to submits evidences regarding allegation made by u against husband. Also in d v case if u prove cruelty court will grant u good amount as compensation. For any legal help call me
