I have lodged a complaint against my husband because he took all my streedhan and kept all the documents. However, the court is asking for documents that I am unable to produce. It has been two years. Recently, I also filed a domestic violence (DV) case against him to recover my streedhan. How long will it take, and how can I get my belongings back easily? He does not attend court, but I appear regularly. The police have also not been able to recover my streedhan and have given the chargesheet.
since there is proceeding pending in court, you need to talk to your Advocate who is conducting the cases. for returning back the stridhan and other articles some purchase bill or vouchers are necessary. otherwise court cannot pass an order this respect. there there DV act case is pending, the husband needs to appear before the Court. in this regard get proper advice with the the relevant documents of your cases.
In your case, you have already taken the correct legal steps by filing a complaint and a Domestic Violence (DV) case for recovery of your streedhan. As per law, streedhan remains the absolute property of the wife, and the husband or his family members have no legal right to retain it.
Since the police have already filed a chargesheet, the matter is now before the court for trial. If your husband is not appearing, the court can issue coercive steps such as bailable/non-bailable warrants against him. You may request your advocate to press for such action to expedite proceedings.
Regarding the recovery of streedhan, you can file an application before the Magistrate under the DV Act seeking immediate return of your articles or compensation in lieu thereof. The court also has the power to pass interim orders for return of streedhan during the pendency of the case.
If you are unable to produce documents, you may file an affidavit explaining that all documents are in the possession of your husband and seek permission to rely on secondary evidence, witnesses, photographs, or any available proof. The burden can shift if you establish that the items were entrusted to him.
Timelines in such matters vary, but with proper follow-up, applications for interim relief and strict action for non-appearance can help in faster resolution.
You should actively pursue:
Application for interim return/compensation of streedhan
Petition for issuance of warrants due to his non-appearance
Submission of alternative evidence regarding your belongings
With consistent legal pressure, recovery becomes much easier.
