Sections filed by wife: 498A (cruelty), 504 (insult), 506 (criminal intimidation), 34 (common intention) Time passed: About 2 years since the FIR/case was filed Current situation: Wife is now asking for her clothes/belongings Is She Legally Allowed to Ask for Her Clothes Now? Yes. Even if a criminal case is filed, the wife has the right to collect her stridhan (personal belongings like clothes, jewellery, etc.). The law supports her claim to personal items, and returning them also shows your cooperation and good faith in court.

Yes, you can mention the jewellery taken in June 2025 in the same declaration. Make sure it’s signed before police or witnesses and properly worded on ₹100 stamp paper. A carefully drafted note can legally protect you — u can reach me for proper guidance and for declaration. regards Adv Afreen Vindhani
