The safest approach in such a situation is indeed to prepare a detailed, itemized list of all her personal belongings such as clothes, jewellery, personal items, documents, etc ideally verified by neutral witnesses and documented on stamp paper or plain paper signed by both parties in the presence of police officers. This record serves as evidence of bona fide compliance and prevents future allegations of theft, destruction, or wrongful withholding of her property. It is advisable to hand over only her undisputed, purely personal articles clothes, footwear, toiletries, or personal gifts not any item that forms part of matrimonial property or disputed assets. If she refuses to sign the acknowledgment despite being offered her belongings, you should immediately make a written record of the same in the police station diary or through an email or complaint letter to the local police station, mentioning the date, time, names of officers present, and her refusal. Make the police responsible witnesses to the processhandover should take place only under their supervision and documentation. This protects you legally and demonstrates good faith. If she brings unknown persons or tries to create drama, calmly refuse to engage and insist that any such recovery be done only through lawful procedure, ideally via a written request through the court where her criminal case is pending. Video record everything start to end without any pauses or edits, let there be witnesses beyond family.

It is advisable to return her personal belongings, such as clothes and ornaments, to avoid future allegations of misappropriation under Section 406 IPC. You can prepare a list of items on ₹100 stamp paper and hand them over in the presence of local police or two independent witnesses. Mention in the memo that all items are returned voluntarily and obtain her signature or thumb impression. If she refuses to sign, make a written note in the police diary or a brief panchanama in presence of witnesses, stating that she declined to acknowledge receipt. Do not refuse to return her belongings, as it can be used against you later. Proper documentation and police presence will protect you from false claims. You can video record everything just make sure that you are doing it in the police station and not at your or her place.
