What will the police do if a supplier has not delivered the material ?

25-Nov-2023 (In Criminal Law)
Dear Sir, My supplier did a fraud with our company. He took money from us and did not supply the raw material. He is from a different state. It is almost 8 months now. We tried for the FIR but the police kept it pending for 2 months giving jurisdiction as the reason and then after all the escalations we got an arrest order 156(3) for the supplier under section 409 and 420. Police again sat over it for 10 days and then logged a FIR. Under this scenario what is action the police is supposed to take, will they arrest the supplier, does the supplier get bail..

First of all police cannot deny filing of fir under the guise of jurisdiction. It is violation of Supreme court guidelines. After filing the fir, they are supposed to investigate the matter and file a report. Securing bail by the supplier depends upon the facts and circumstances presented before the court.
