What to do since lesbian partner taken back forcefully by parents?

31-Dec-2023 (In Criminal Law)

We are lesbians. My partner left with me from their parents home. Now her parents have taken her back forcefully. What action can i take in such situation? We both are 28 and 27 years old. We were staying together for 15 days.

First you must determine whether your partner would want to be with you against her parents wishes. If she wants to then there are several things you may do. Approach the local police station stating you are a concerned friend and that she is being illegally detained. Though the police will usually not interfere in such cases unless you push forward and state that she has been kidnapped and illegally detained. You will need to bolster your complaint by stating that she is being tortured etc. Avoid pointing out to the police that you are partners.

You can also file a writ of habeas corpus in the High Court and the Court will require her to be produced in court. Also, do approach NGOs that work in this field and would be able to help such as Centre For Social Research. Feel free to get in touch if we could be of any further assistance to you.
