Threatening of being jailed under false dowry case

06-Apr-2023 (In Criminal Law)

Sir, my elder brother and his fiancee broke their marriage after engagement under mutual understanding. Now the family of the girl is asking for a hefty amount for compensation against expenses incurred in engagement (which we have cross checked with the banquet owner is a falsely quoted amount). They are threatening my family that if won't pay them the amount they will book us under Dowry act and will get my entire family jailed .The uncle of the girl threatened us that he is a magistrate and all he get my entire family jailed. No dowry was demanded ever.Instead we gifted girl gold ornaments.

Hi,
There is no automatic arrest in case of dowry cases as the supreme Court ruled in the matter of arnesh Kumar, however if f.I.r is lodged by the other side you have options to get it quashed, no one can send you and your family if your case is genuine.

Dear owner of the case as i can understand that its a case of the engagement break up and leading to such incidents of false allegations like dowry and settlement of expenses, such cases become very complicated if they are not handled with due care so i would suggest you to associate a professional lawyer to handle such case as matter can get worse if the proper reply is not given to the the aggrieved party of the girl family.
